Presentation One: Legislative Update

Tommy Simmons
Legal Counsel to Chair Ruth R. Hughs at Texas Workforce Commission

Legislative Update:  Mr. Simmons will discuss what employers need to know with a focus on new Texas Workforce Commission cases related to Texas Payday Law, unemployment, discrimination, and retaliation.   Mr. Simmons’ presentation will include a Legislative Update on employment-related bills before the Texas legislature including paid sick leave, as well as TWC’s new gig-economy worker classification test.

FSLA Update: Ms. Price will discuss HR best practices for wage and hour issues, including analyzing overtime exemptions, proper overtime pay, worker classification and recent case law interpreting Federal and Texas wage and hour law.

Bios:

As a private­sector employment law attorney from 1998 to 2004, Tommy Simmons advised and represented businesses in employment law matters, and operated an online employment law information site focused on the needs of employers. In the public sector, Mr. Simmons is the senior legal counsel for Commissioner Hope Andrade, the employer representative on the Texas Workforce Commission, and served in the same capacity for the prior employer representatives on the Texas Employment Commission and the Texas Workforce Commission, Commissioners Mary Scott Nabers, James J. Kaster, Chairman Bill Hammond, Commissioner Ron Lehman, and Chairman Tom Pauken from 1987 through 1998, and 2004 through the present. From 1984 until early 1987, Mr. Simmons served on the legal staff of the Office of Commission Appeals in TEC.

Ann Price helps employers navigate the increasingly complex web of laws that govern the workplace by providing strategic advice and counsel; training managers and supervisors; guiding and conducting investigations; drafting policies, handbooks, and contracts; and defending against allegations of noncompliance in courts and administrative forums. Ann leverages her 25 years of experience representing employers to provide practical and cost-effective solutions to prevent and address workplace problems.

Reservation/Cancellation Policy

Registrations must be received before close of business on the Monday prior to the event so that we may turn in a headcount.  Onsite registrations are accepted at the door on a first-come, first-served basis. If you can't make the event, please let us know 72 hours beforehand by sending an email to ahrma@austinhumanresource.org, so that we can cancel your registration. Please note, refunds will not be issued after the 72 hour mark as we pay the venue based on the number of attendees reserved - including no-shows.
